Petycja w sprawie zniesienia zakazu sprzedaży alkoholu przez internet, kierowana do Kancelarii Prezesa Rady Ministrów, posłów oraz senatorów RP
Polscy przedsiębiorcy produkujący piwa, wina oraz inne napoje alkoholowe podczas stanu epidemii pozbawieni są możliwości sprzedaży swoich wyrobów. Polski kraft, branża winiarska i spirytusowa umierają wskutek wprowadzonych regulacji. Ograniczenia dotykają także gastronomię, gdyż napoje alkoholowe nie mogą być sprzedawane z dowozem.
W wyniku zakazów i ograniczeń wprowadzonych przez rząd napoje alkoholowe nie mogą być sprzedawane w pubach i restauracjach. Nadto, wprowadzono ograniczenia w funkcjonowaniu sklepów, zakazano organizacji zgromadzeń, w tym festiwali piwnych. Małe polskie browary rzemieślnicze pozbawione dostępu do dyskontów spożywczych straciły większość punktów dystrybucji. Całej branży grozi upadek i całkowite zdominowanie przez zachodnie koncerny.
Sprzedaż alkoholu regulowana jest w Polsce przestarzałą ustawą o wychowaniu w trzeźwości uchwaloną podczas stanu wojennego. W tamtych czasach nikt nie myślał o sprzedaży przez internet. Aktualny stan prawny zezwala na sprzedaż alkoholu jedynie w miejscu wskazanym w zezwoleniu na sprzedaż napojów alkoholowych. Sądy administracyjne konsekwentnie uznają, że dowóz i wysyłka alkoholu do klienta łamie ten zakaz.
Przepis
ten stwarzał dużo problemów branży już wcześniej, jednak
obecnie przyczynić się może do upadku setek firm, które
pozbawione są możliwości sprzedaży swoich wyrobów. Działalność
browarów, branży winiarskiej i spirytusowej nie stwarza
niebezpieczeństwa zakażenia, nie trzeba jej z tego powodu zamykać
i nie ma przyczyny, dla której mają one aktualnie faktyczny zakaz
działania. Nie mogą one działać jedynie z uwagi na nieżyciowy,
archaiczny przepis. Kongres Polskiego Biznesu postuluje umożliwienie
wszystkich punktom, które posiadają zezwolenie na sprzedaż
alkoholu prowadzenie sprzedaży online, na wynos i z dowozem.
